Important: Fluvenar provides flood risk assessment and insurance cost modeling for informational purposes only. Nothing on this Site constitutes insurance advice, an insurance quote, or a recommendation to purchase any specific flood insurance policy. Always verify flood zone data, premium estimates, and coverage details with a licensed insurance agent before purchasing.

These Terms of Service ("Terms") govern your access to and use of Fluvenar (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Fluvenar, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Fluvenar uses publicly available FEMA flood hazard data, USGS river gauge measurements, NOAA precipitation records, OpenFEMA claims data, and actuarial modeling to help property owners and homebuyers assess flood risk. The Service provides flood zone classification, NFIP premium projections, Monte Carlo premium trajectory simulations, Total Flood Ownership Cost calculations, mitigation ROI analysis, and insurance decision frameworks. The Service is informational only.

3. Not Insurance Advice

Fluvenar is not a licensed insurance broker, agent, or adjuster. The premium estimates and risk assessments provided are based on publicly available data, the published FEMA Risk Rating 2.0 methodology, and statistical models. They do not constitute insurance quotes, recommendations to purchase or decline any specific flood insurance policy, or representations about your actual NFIP or private flood insurance premiums.

You should always:

  • Verify flood zone data with your local floodplain administrator
  • Obtain actual premium quotes from a licensed flood insurance agent
  • Review your elevation certificate (if available) for accurate BFE data
  • Consult a licensed insurance agent for personalized coverage advice
  • Not rely solely on our estimates when making insurance purchasing decisions

4. Data Accuracy Disclaimer

Our assessments are derived from FEMA NFHL, OpenFEMA, USGS NWIS, NOAA, and FEMA CRS datasets that are updated on their own schedules. Flood maps may not reflect the most recent conditions, especially after major flood events or FEMA remapping activities. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of data derived from third-party government sources.

Premium estimates are projections, not quotes. NFIP glide path rules, remapping, policy changes, and individual property characteristics may cause actual premiums to differ materially from our estimates. Monte Carlo simulations model uncertainty but cannot predict future policy changes or climate events.

5. Permitted Use

You may use the Service for lawful personal or commercial research purposes. You agree not to:

  • Reproduce, resell, or sublicense our assessment outputs without a commercial license
  • Scrape or systematically extract data from the Site beyond API rate limits
  • Use the Service to discriminate against any person in violation of applicable law
  • Represent our data as official FEMA data or as insurance advice
  • Attempt to reverse-engineer our modeling algorithms or scoring methodology
  • Use the Service to harass, defame, or harm any person or entity

6. Credits and Billing

Fluvenar uses a per-report credit system. Credits are purchased as one-time payments (not subscriptions) via Stripe. Single reports cost 1 credit ($12), report packs provide 5 credits ($39), and API credit packs are available for developers. All fees are in U.S. dollars and are non-refundable except as required by applicable law. We may change pricing with 30 days' notice.

7. API Access

API subscribers receive API access subject to rate limits specified in the API documentation. API credentials are non-transferable. You are responsible for securing your API keys. We reserve the right to suspend API access for abuse or excessive usage.

8. Intellectual Property

The Service, including its design, modeling methodology, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright and other intellectual property laws. The underlying government datasets are in the public domain. Our original expression, analysis, and modeling methodology are proprietary.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Smart Technology Investments LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property or confidential information.

13. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or prominent Site notice. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account by contacting us and ceasing use of the Service. Unused credits are non-refundable upon termination.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Technology Investments LLC with respect to the Service and supersede all prior agreements or understandings.
